StudyMapp is licensed, not sold, to you. Your use of StudyMapp is subject to your acceptance of these terms. StudyMapp is provided by Building Five Technologies Inc. ("Building Five", "we", "us"), and not by Apple. We reserve all rights in and to StudyMapp that are not expressly granted to you here.

  1. Scope of License

We grant you a nontransferable license to use StudyMapp on any Apple-branded products that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions. These terms also cover any content or services reached from inside StudyMapp, and any updates that replace or supplement it, unless an update comes with its own agreement.

Except as the Usage Rules allow, you may not distribute or make StudyMapp available over a network where several devices could use it at the same time. You may not transfer, redistribute, or sublicense it, and if you sell your device you must remove StudyMapp from it first.

You may not copy StudyMapp except as this license and the Usage Rules permit, and you may not reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works from StudyMapp or any part of it. This restriction does not apply where the law prohibits it, or where the licensing terms of an open source component included in StudyMapp permit otherwise.

StudyMapp includes third-party components distributed under open source licenses. Those components remain governed by their own licenses. Where a term of an open source license conflicts with these terms, that license prevails, but only for the component it covers and not for the rest of StudyMapp. Nothing in these terms limits any right an open source license grants you, and nothing in an open source license extends to any other part of StudyMapp.

  1. Your Content and Your Data

The notes, images, PDFs, and review history you put into StudyMapp remain yours. We claim no ownership of them and no license to use them.

StudyMapp does not collect personal information. Your content is stored on your device and, if you enable iCloud, in the private database of your own iCloud account, which we cannot access. We do not receive analytics, telemetry, crash reports, or usage data of any kind. See the Privacy Policy for detail.

You are responsible for the content you import and for having the appropriate legal rights to import it. StudyMapp does not check what you put into it.

  1. Term and Termination

This agreement takes effect when you first use StudyMapp and continues until it is terminated by you or by us. Your rights under it end automatically if you do not comply with its terms. You may end it at any time by deleting StudyMapp from your devices. Sections e, f, and g survive termination.

  1. Subscriptions

StudyMapp offers a limited free tier and an optional auto-renewing subscription. Subscriptions are sold and administered by Apple through your Apple Account. Price and billing period are shown in the app before you purchase.

A subscription renews automatically unless you cancel at least 24 hours before the end of the current period. You manage and cancel subscriptions in the Apple Account settings on your device, not in StudyMapp. We cannot cancel a subscription or issue a refund on your behalf. Refunds are handled by Apple under its own policies.

If your subscription lapses, your notes are not deleted. Access to paid capacity ends, and notes above the free limit become read-only until you resubscribe or remove enough notes to fall back under the limit.

  1. External Services

StudyMapp may let you reach services or websites operated by us or by third parties. You use them at your own risk. We do not review or evaluate third-party content and are not responsible for it. External services may be unavailable in some places or languages, may change, and may be withdrawn at any time without notice to you. You are responsible for complying with any laws that apply to your use of them.

  1. No Warranty

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STUDYMAPP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES AND CONDITIONS, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NONINFRINGEMENT. NO INFORMATION OR ADVICE GIVEN BY US CREATES A WARRANTY. IF STUDYMAPP PROVES DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING OR CORRECTION.

WE DO NOT WARRANT THAT STUDYMAPP WILL BE UNINTERRUPTED OR ERROR FREE, THAT SYNC WILL ALWAYS SUCCEED, OR THAT YOUR CONTENT WILL NOT BE LOST. YOU ARE RESPONSIBLE FOR KEEPING YOUR OWN BACKUPS.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITS ON A CONSUMER'S STATUTORY RIGHTS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

  1. Limitation of Liability

TO THE EXTENT NOT PROHIBITED BY LAW, WE ARE NOT LIABLE FOR PERSONAL INJURY OR FOR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL LOSS ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE STUDYMAPP, HOWEVER CAUSED AND REGARDLESS OF THE THEORY OF LIABILITY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

EXCEPT WHERE THE LAW REQUIRES OTHERWISE IN CASES INVOLVING PERSONAL INJURY, OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES SHALL NOT EXCEED FIFTY DOLLARS ($50.00). THESE LIMITS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

  1. Export Compliance

You may not use, export, or re-export StudyMapp except as authorized by United States law and by the laws of the place where you obtained it. In particular, StudyMapp may not be exported or re-exported into any U.S. embargoed country, or to anyone on the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce Denied Persons List or Entity List. By using StudyMapp you represent that you are not located in any such country and are not on any such list.

  1. U.S. Government End Users

StudyMapp and its documentation are "Commercial Items" as defined at 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation" as those terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202. They are licensed to U.S. Government end users only as Commercial Items and with only the rights granted to all other end users under these terms.

  1. Apple

This agreement is between you and us, not with Apple. Apple is not responsible for StudyMapp or its content. Apple has no obligation to provide maintenance or support for StudyMapp. If StudyMapp fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to StudyMapp.

We, not Apple, are responsible for addressing any claim by you or a third party relating to StudyMapp, including product liability claims, claims that StudyMapp fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar law. We, not Apple, are responsible for investigating and defending any third-party claim that StudyMapp infringes intellectual property rights.

Apple and its subsidiaries are third-party beneficiaries of these terms and, on your acceptance, will have the right to enforce them against you.

  1. Changes

We may update these terms. The current version will always be posted at this address with the date at the top. Continuing to use StudyMapp after a change means you accept the updated terms.
